Important Notice: These terms include a binding arbitration agreement and a class-action waiver. See Section 3 for details.
These Terms of Service govern all use of elcajongaragedoorrepair.com and any service request submitted through the site or by phone. By accessing elcajongaragedoorrepair.com or submitting a request, the visitor accepts these terms in full. Anyone who does not agree with these terms should not use the site or submit a request.

1. Limitation of Liability
elcajongaragedoorrepair.com and the referral service are provided by Mainspring Garage Door Co. on an as-is and as-available basis. Mainspring Garage Door Co. makes no warranty that a partner business will be available, will contact the user, or will produce any particular result from a referral.
To the fullest extent permitted by applicable law, Mainspring Garage Door Co. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including lost profits, lost data, or property damage, even if Mainspring Garage Door Co. has been advised of the possibility of such damages.
For any claim arising from the user’s use of elcajongaragedoorrepair.com or the referral service, Mainspring Garage Door Co.’s total aggregate liability is capped at one hundred dollars ($100.00) - which typically exceeds anything a user has paid Mainspring Garage Door Co. directly, since referral matching is provided at no charge to the user.
This cap applies solely to Mainspring Garage Door Co.’s own conduct in operating the site and the referral matching process. Responsibility for the work itself - including workmanship, safety, outcome, and any resulting damage or loss - rests entirely with the independent business that performed it, not with Mainspring Garage Door Co..
2. Dispute Resolution; Arbitration; Class-Action Waiver
(a) Informal Resolution First. Before initiating any formal proceeding, the user agrees to contact Mainspring Garage Door Co. through https://elcajongaragedoorrepair.com/contact-us/ and allow a reasonable opportunity - at least thirty (30) days - to resolve the dispute informally.
(b) Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these terms, elcajongaragedoorrepair.com, or the referral service that is not resolved informally will be settled by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as in effect at the time the claim is filed. Neither party will litigate such a claim in court, except as stated below. Each party gives up the right to sue in court and the right to a jury trial except as expressly preserved in this section.
(c) Class-Action and Collective-Action Waiver. All claims must be brought in an individual capacity only. The user and Mainspring Garage Door Co. each waive the right to bring or participate in any class action, collective action, or consolidated action, and neither may seek class or representative arbitration. The arbitrator has no authority to consolidate claims from more than one person or to preside over any form of class or representative proceeding.
(d) Jury Waiver. To the extent any claim proceeds in a forum other than arbitration as permitted below, both parties waive the right to a trial by jury.
(e) 30-Day Opt-Out. A user may opt out of this arbitration agreement by sending written notice within thirty (30) days of first accepting these terms through https://elcajongaragedoorrepair.com/contact-us/. Opting out has no effect on any other provision of these terms.
(f) Small-Claims and Injunctive-Relief Carve-Out. Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies. Either party may also seek emergency injunctive or equitable relief in a court of competent jurisdiction to address misuse of elcajongaragedoorrepair.com or infringement of intellectual property rights.
3. How the Service Works
Mainspring Garage Door Co. operates elcajongaragedoorrepair.com as a marketing and customer-referral business serving the home-services market in El Cajon, CA and surrounding areas. The site advertises home services, accepts service requests from visitors online and by phone, and forwards those requests to independent businesses in its referral network.
Every estimate, repair, installation, service call, or other work connected to a request is performed by the licensed independent contractors and partner firms that make up that network. Mainspring Garage Door Co. does not perform home-service work of any kind. It has no tradespeople, crews, or field personnel, and it does not employ or direct the individuals who carry out the work.
Scheduling, pricing, materials selection, and the scope of any job are determined solely by the independent business that accepts the request. Availability of a qualified business for any given request is not guaranteed. The referral process begins when a request is submitted; nothing in these terms obligates any business to accept, contact the user, or complete a job.
4. Indemnification
The user agrees to indemnify, defend, and hold harmless Mainspring Garage Door Co., its owners, officers, employees, and affiliates, as well as the independent contractors and partner businesses in its referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising out of or related to:
- the user’s access to or use of elcajongaragedoorrepair.com;
- the accuracy of information the user submits, including the user’s authority to provide the phone number given and consent to be contacted at that number;
- any breach by the user of these terms or of any applicable law or regulation; and
- the user’s interactions, transactions, or disputes with any independent business to which the user is referred.
This indemnification obligation survives the termination or expiration of the user’s use of the site and these terms.
5. Independent Contractors; No Liability for Partner Work
The businesses that perform work through referrals from Mainspring Garage Door Co. are independent contractors. They are not employees, agents, legal partners, joint venturers, or representatives of Mainspring Garage Door Co., and Mainspring Garage Door Co. does not control the manner or means by which they carry out their work.
Mainspring Garage Door Co. is not responsible or liable for any independent business’s workmanship, the quality, safety, or timeliness of its work, its pricing or billing practices, its licensing or insurance status, its employees or subcontractors, or any act, omission, negligence, injury, property damage, or other loss caused by that business or its personnel.
The service agreement for any job is formed directly between the customer and the business that performs the work. Mainspring Garage Door Co. is not a party to that agreement and assumes no obligations under it. A referral from Mainspring Garage Door Co. is not an endorsement, certification, or guarantee of any business or its work. Customers are encouraged to verify licensing and insurance independently and to obtain and read a written contract before authorizing any work. Any dispute about work performed is between the customer and the performing business.
6. No Warranty on Work; Coordination Remedy
Because Mainspring Garage Door Co. performs no home-service work, it gives no warranty or guarantee of any kind on workmanship, parts, or materials. Any warranty on the job itself is the responsibility of the independent business that performed it, and any warranty on parts or equipment comes from the manufacturer on the manufacturer’s own terms. Customers should request warranty terms in writing from the performing business before work begins.
If a customer is dissatisfied with completed work, the only role Mainspring Garage Door Co. plays is that of a go-between: upon request, it will contact the performing business and ask that it return to address the customer’s concern. This is a courtesy coordination effort only - it is not a guarantee of any particular outcome, and the performing business’s response is entirely its own decision. Mainspring Garage Door Co. will not perform, redo, or repair the work itself under any circumstances.
Nothing in this section creates any obligation on Mainspring Garage Door Co. to refund amounts paid by a customer to a performing business.
7. Changes to These Terms
Mainspring Garage Door Co. may revise these terms at any time. The revision date shown at the top of the page reflects when the current version took effect. Continued use of elcajongaragedoorrepair.com or submission of a service request after a revision constitutes acceptance of the updated terms. Users who do not agree with a revised version should stop using the site.
8. Text Messaging (SMS) Disclosure
By submitting a service request through elcajongaragedoorrepair.com or by phone, the visitor consents to receive calls and text messages from Mainspring Garage Door Co. and from the independent business or professional that receives and handles the visitor’s request. Those communications may be placed using an automatic telephone dialing system (autodialer) or may include prerecorded or artificial-voice messages.
Consent to receive calls or text messages is not a condition of purchasing any goods or services.
Message frequency varies depending on the nature of the request and how quickly a partner business responds. Message and data rates may apply based on the visitor’s wireless carrier and plan.
To stop text messages at any time, reply STOP to any message. Reply HELP to any message for assistance. Opting out of text messages will stop SMS communications but will not automatically cancel other forms of contact regarding an open or pending request unless the visitor separately requests that through https://elcajongaragedoorrepair.com/contact-us/.

9. Governing Law and Venue
These terms are governed by the laws of the State of CA, without regard to its conflict-of-law principles. Subject to the arbitration agreement in Section 2, any court proceeding that is permitted under these terms must be brought exclusively in the state or federal courts located in CA, and each party submits to the personal jurisdiction of those courts.
